Only a very small number of palliative care cases reported in either the legal or general literature have involved criminal prosecution. Commentaries have concentrated on the disincentives such prosecutions may have on the treatment of pain. There is a somewhat broader array of cases that have examined the potential liability of careproviders in other medical scenarios. |
