Judge Certifies Class in Ohio OxyContin Suit By Lindsay F. Wiley [Bio] August 30, 2002 - A judge in Butler County, Ohio has ruled that a class action suit brought by OxyContin users may go to trial. This is the first time a judge has certified a statewide class of OxyContin users, according to Stanley Chesley, an attorney for the plaintiffs. The lawsuit was brought by Ohio residents who claim that they became addicted to OxyContin against Abbott Laboratories and Purdue Pharma, Inc. Purdue Pharma sells OxyContin and Abbott Laboratories markets the drug. The class action plaintiffs seek unspecified monetary damages. They do not ask the court to halt the sale of the drug. Purdue Pharma has generally been successful in defending suits by OxyContin users. Last week, a West Virginia judge dismissed a suit over the marketing of the drug. The company maintains that it has not settled any of the suits brought by OxyContin users or their families.
