Patient Sues Over Long Stint in Waiting Room

By Lindsay F. Wiley [Bio]

August 21, 2003 - A pain management specialist in Nevada is appealing a $250 small claims judgment in favor of a patient who waited more than three hours in his office without receiving treatment. The patient, Aristotelis Belavilas, was scheduled to have a steroid injection to treat his back pain.

He says he sued because Dr. Ty Weller never apologized for making him wait. "I'd like to drop everything if he would just apologize," Belavilas said. "My biggest concern is that he was rude." Dr. Weller has filed a formal objection to the small claims court’s ruling. "If he wants an apology he can have one, but I think he owes me an apology, frankly, for making me go to court for 2 1/2 days and making me close my practice and filing a frivolous lawsuit," Weller said. "I think he represents everything that’s wrong with this country."
