State Medical Boards (although as reflected below they go by many different names) have two primary tasks; they license doctors who wish to practice medicine with in the state and discipline those who are licensed for breaches of the law (statutes, rules and policies). In the process medical boards investigates complaints, conduct physician evaluations, facilitate rehabilitation and promulgates and publishes rules, regulations and policies.

In May 1998 the Federation Of State Medical Boards (FSMB) issued Model Guidelines for the Use of Controlled Substances for the Treatment of Pain [HTML]. In addition several State Medical Boards have adopted specific pain policies that relate to palliative care.

State Medical Boards perform other functions such as approving specialty boards. For example, in American Academy of Pain Management v. Joseph, 164 F.3d 629 (Table) (9th Cir. 1998) the American Academy of Pain Management (AAPM) was denied the status of a specialty board, with the result that their members could not advertise themselves as "board certified" in California. AAPM argued that the statute and regulations in question were unconstitutional as impacting free speech rights. The district court denied the Academy's application for a preliminary injunction and the Ninth Circuit Court of Appeal affirmed. $[Lexis] $[Westlaw] (Select from table)
